Terms and Conditions

“The BMC recognizes that climbing and mountaineering are activities with a danger of personal injury or death.

Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.”

Participants are reminded by Atkinson Outdoors that ‘hill walking’ and ‘hiking’ are activities with a danger of personal injury or death and that individuals should be aware of and accept these risks and be responsible for their own actions and involvement.

BOOKING

1.

1.1 Activity fees are inclusive of all costs except otherwise stated.

An activity can only be reserved by submitting the completed booking form, voluntary medical disclosure, statement of participation & full payment.

1.2 By paying and booking the course/activity fee the date is set and the client is accepting the Terms and Conditions stated on this document. If full payment is not received by Atkinson Outdoors by the date specified in the Confirmation Invoice or 24 hours before, I reserve the right to cancel your booking.

1.3 Participants may wish to consider taking out their own insurance against personal accident and personal injury as well as cancellation of courses. This needs to cover the activities that participants will be undertaking in their course or activity. Such insurance may be obtained from: British Mountaineering Council from www.thebmc.co.uk.

1.4 A participation consent form with a participation statement will be supplied in our application forms and this should be signed and agreed as a term of booking. On receipt of your booking enquiry and forms we will contact you to confirm your booking and issue a ‘Booking Agreement’ and an invoice. Your booking will only become confirmed upon receipt of payment. 

1.5 Once confirmed, we will issue your course/activity itinerary, details, kit list and other useful information. If any details on the Booking Agreement and invoice are incorrect please tell us immediately. It is your responsibility to safely be at the location for the proposed course/activity on time and provide any food/drink/kit detailed.

1.6 A voluntary disclosure medical form will be supplied for clients to fill in before any activity. This will be kept fully confidential and is for the protection of the client.

1.7 Atkinson Outdoors is a member of the IOL so be assured any data you provide will be handled professionally and only shared for outlined purposes in privacy statement.

1.8 A kit list will be supplied before the activity. Atkinson Outdoors reserves the right to reschedule or cancel any activity if insufficient kit is brought. This is purely in the interests of health and safety and for the comfort of participants. NB: The instructor/guide is under no obligation to replace/repair personal belongings lost or damaged whilst under our care, not caused by the negligence of the instructor/guide.

1.9 A clear statement of the activity to be undertaken and the expectations of the client will be agreed before the day and reiterated during initial briefings. No guarantee is made for clients to reach the summit of a particular peak.  Safety overrides any other objective.  Clients must agree to follow the decisions of the instructor/guide. Once an activity/course has commenced but the full activity/course is not completed there is no obligation by the instructor/guide to offer another date/activity.

1.10 A full risk assessment of the planned activity will be completed before, and dynamically during said activity to minimize risk to clients and Atkinson Outdoors. 

1.11 Age Restrictions

Our current minimum age limit is 18 years of age, there is no upper age limit but it should be noted that you are undertaking physical and sometimes challenging activities. 

1.12 You may be requested to leave the course or activity if it is deemed that: your health may be at risk; you are not coping; you may not cope with the demands of the course; an illegal act has been or may be committed; or your conduct is detrimental to the safety, enjoyment or well being of an individual or the group. You must refrain from any conduct which may give offence or cause danger or damage to any person or property.


2 CONTENT

2.1 Neither I nor any third parties provide any warranty or guarantee as to the accuracy, timeliness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

2.2 In no event will Atkinson Outdoors be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits’ arising out of, or in connection with, the use of this website or Atkinson Outdoors facebook page.

2.3 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.


3 COMPLAINTS

3.1 In the unlikely event you should wish to lodge a complaint please feel free to contact me to address any issue, and, if still required, please then put this in writing by emailing Atkinson Outdoors within 28 days after an activity has concluded. Addressed to Atkinson Outdoors, International House, 12 Constance Street, London, E16 2DQ.

3.2 I endeavour to resolve misunderstanding or other issues as soon as possible for any client. You must report, in the first instance, report to Miss Ruth Atkinson, any problems that arise during the course/activity. 

3.3 In any correspondence please include any booking reference number, your details and the exact and full details of your complaint. You may prejudice our ability to resolve your problem and/or investigate it fully if you fail to take these steps and any right to compensation you may have had will be lost or substantially reduced.

4 CANCELLATIONS


Cancellation by client/participant

4.1 Should a client wish to cancel a booked activity please contact Atkinson Outdoors as soon as possible by phone, or by email. If in writing; addressed to Atkinson Outdoors, International House, 12 Constance Street, London, E16 2DQ.  Atkinson Outdoors will need to acknowledge this.  A full refund will be provided for cancellations up to 48 hours before the event. After that only 50% of paid monies will be refundable to the client.

4.2 Whilst every attempt is made to ensure that courses/activities actually run, Atkinson Outdoors reserves the right to notify customer/s of cancellation if required as soon as practicable where it believes on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the course/activity. For example due to a ‘Force Majeure’ (an event beyond our control, such as war, riots, disturbances, terrorist activity, natural disasters, actual or potential severe weather conditions, and any other similar events).The instructor/guide has the right to refuse or accept individuals on activities/courses if deemed to be inappropriately dressed and or under-prepared, under the influence of drugs and/or alcohol or of an unstable character.

In the event of cancellation by Atkinson Outdoors, customers will be offered the choice of the following options:

Full refund of the fee paid; or

Another booking on a different date

5 LEGAL


5.1 Any case brought against Miss Ruth Atkinson or associates must be conducted in the United Kingdom.

5.2 Atkinson Outdoors is fully insured with Marsh Sport. This insurance applies for all activities within the remit of the Mountain Training qualifications currently held, including low level team building activities, bush-craft, route setting, film and media work. Currently activities insured for fall underneath the scope and remit of the following Mountain Training qualifications; Hill and Moorland Leader, Expedition Module, Mountain Leader, Climbing Wall Instructor, Climbing Wall Development Instructor, Climbing Wall Instructor Abseil Module, Foundation Coach Award and Development Coach Award.


6. PHOTOS


6.1 Atkinson Outdoors may request to use photos or videos taken during activity for company publicity purposes only. Please inform us if you do not wish us to use these.


7. COVID 19/Infectious illness

Atkinson Outdoors will continue to minimise Covid 19 transmission risks whilst it is still circulating, and respect others if they wish to maintain distancing and use appropriate PPE.

If you have or are showing any noteable symptoms of covid or other infectious flu like illness you may not be allowed to participate. If you have arrived at an activity location showing noteable symptoms that may affect others you may be asked to go home. If you start to feel ill during an activity you must inform us so we can help you, protect other clients and ourselves.


If you have recently self isolated, shown other symptoms, had Covid 19, (tested positive), and recovered or have other relevant medical info (for example-high risk groups), please put this on your medical disclosure form. If you attend an activity with Atkinson Outdoors you are acknowledging the current risks of participating in the relevant activities and acknowledge that claims in relation to Atkinson Outdoors in conjunction with Covid 19 will not be supported.


To try to mitigate risk, Atkinson Outdoors carries a first aid kit which will include gloves, face covering and hand sanitiser. This first aid kit will be checked and updated regularly.

Hand sanitiser will be available. Participants are advised to bring their own (at least 50% alcohol) to further avoid cross contamination. Use regularly especially before eating. Wash hands before and after day.

The instructor will have a personal mask or covering available.Participants should bring their own if desired.

Distances will be maintained where a participant is medically vulnerable and wishes us to respect their space.

For navigation events we will avoid sharing equipment. Maps and compasses will be handed out to be used all day by individuals. Then at the end of the day, participants will place kit in a bag to be sealed. Then de-contamination by cleaning of maps and any other borrowed kit will be done at the end of every session by Atkinson Outdoors with recommended cleaning items/advice.

Pens and notebooks to be supplied by client for personal use if required.


There is a maximum of 8 people on walks at present.

Location of activity may vary to lessen the impact on currently more popular beauty spots and to work in line with weather or other events. Participants will be informed of any changes in advance.

Travel to venues will be in separate vehicles, except for people from the same household. Atkinson Outdoors does not accept responsibility for participants personal vehicles or any losses.
